CONDITIONS ATTACHED TO THE GRANT OF THIS LICENCE
This licence is granted subject to any Mandatory Conditions imposed by the Licensing Act 2003, Embedded Conditions carried across on conversion of your previously held Justices Licence, Conditions Converted from any previously held Public Entertainments Licence, Conditions volunteered on the application form to be undertaken by the applicant and where necessary, Conditions imposed by the Licensing Authority in order to promote the Licensing Objectives.
1. Mandatory Conditions:
c Any Door Security staff employed to carry out a security activity at the premises must be licensed with the Security Industry Authority (SIA).
d. In respect of the exhibition of films as mentioned below:
1 The admission of children to the exhibitions of any film is restricted as follows:
2 Where the film classification body is specified in the licence, unless 3(b) below applies, the admission of children is restricted in accordance with any recommendation of that body.
3 Where:-
(a) the film classification body is not specified in this licence, or
(b) the licensing authority has notified the holder of the licence that this subsection applies to the film in question,
the admission of children is restricted in accordance with any recommendation made by the licensing authority.
4 In relation to the above:
“children” means persons under the age of 18 years; and
“film classification body” means the persons or person designated as the authority under section 4 of the Video Recordings Act 1984.
Appendix B
Embedded Conditions
1. Notwithstanding anything herein contained the within mentioned building shall not be used for cinematograph or other exhibitions to which the Cinemas Act 1985 apply unless such building complies in all respects with the Provision of the Acts under regulations made thereunder and the recommendations on safety in cinemas by the Home Office.
2. The within mentioned building shall not be open for the purposes for which this licence is granted at any time other than between the hours of 9.00 am and 11.00 pm on Mondays to Saturdays inclusive and between the hours of 12 noon and 11.00pm on Sundays, except with the prior written consent in writing of the Licensing Authority.
3. Proper lavatory accommodation shall be provided in or in connection with the said building and maintained in all respects to the satisfaction of the Licensing Authority.
4. No person under fourteen years of age shall be admitted to the premises if the Licensing Authority notify the Licensee that there is an excessive prevelance of infectious disease in the district.
5. All doors from the auditorium which might be mistaken for exits shall be marked "No Thoroughfare" in such manner as may be prescribed by the Licensing Authority.
6. No film shall be exhibited unless
a) It has received a "U" "PG" "12" "15" or "18" certificate of the British Board of Film
Censors or
b) it is a current news reel which has not been submitted to the British board of Film
Censors
7. No person apparently under the age of eighteen years shall be admitted to any exhibition at which there is to be shown any film which has received an "18" certificate from the British board of Film Censors.
8. No person apparently under the age of fifteen years shall be admitted to any exhibition at which there is to be shown any film which has received a "15" certificate from the British Board of Film Censors.
9. No person apparently under the age of twelve years shall be admitted after the hour of seven in the evening of any day to a cinematograph exhibition at any premises in the course of which there is to be shown any film or portion of a film, being a film or portion of a film which shall have been shown to the public at those premises on that day before the hour of seven in the evening unless that person is accompanied by or in the charge of another person who appears to have attained the age of sixteen years.
10. No person apparently under the age of five years shall be admitted to a cinematograph exhibition unless that person is accompanied by or in the charge of a person who appears to have attained the age of sixteen years.
11. Notwithstanding the conditions hereinbefore contained, a film may be exhibited and persons or any class of persons may be admitted thereto if the permission of the Licensing Authority is first obtained in writing and any conditions of such permission are complied with.
12. A representation or written statement of the terms of any terms of any certificate given by the British Board of Film Censors shall be shown on the screen immediately before the showing of any film to which it relates and the representation or statement shall be shown for long enough and in a form large enough for it to be read from any seat in the auditorium.
13. There shall be prominently exhibited, at each public entrance whenever the premises are open to the public, a notice indicating in tabular form and in clear bold letters and figures
a) The title of each film to be shown on that day, other than trailers and films of less than
five minutes duration.
b) the approximate times of commencement of each such film
c) whether each such film has received a "U" "PG" "12" "15" or "18" certificate from the
British Board of Film Censors and
d) the effect of such "U" "PG" "12" "15" or "18" certificates in relation to the admission of
persons under the age of eighteen years
The notice shall be not less than 36 inches by 26 inches in dimensions and shall be in the form specified hereunder, the distinguishing letters "U" "PG" "12" "15" and "18" being not less than 1.1/2 inches in height.
TIME-TABLE OF FILMS FOR TODAY
Category "U" - Passed for general exhibition
Category "PG" - Passed as suitable for general exhibition but parents or guardians are
advised that the film contains material they might prefer children under
fifteen years not to see
Category "12" - This category is intended to apply to those films which are not entirely suitable for all the exercise of parental discretion under the existing "PG"
(Parental Guidance) classification but which are suitable for children and young people at an earlier age than the next category which is "15"
Category "15" - Passed as suitable for exhibition to persons of fifteen years or over. When a programme includes a "15" film no person under fifteen years can be admitted.
Category "18" - Passed for exhibition to adults. When a programme includes an "18" film
no person under eighteen years can be admitted.
Category Title of Film Time
14. The nature of any certificate received in respect of a film from the British Board of Film Censors shall be clearly indicated by the letter "U" "PG" "12" "15" or "18" in any advertisement of the film displayed at the premises.
15. No Advertisement displayed at the premises of a film to be exhibited at the premises shall depict as a scene or incident in the film any scene or incident which is not included in the film as certified by the British Board of Film Censors or approved for exhibition by the Licensing Authority, as the case may be.
16. Where the Licensing Authority have given notice in writing to the Licensee of the premises objecting to an advertisement on the grounds that if displayed it would offend against good taste or decency or be likely to encourage or incite to crime or to lead to disorder or to be offensive to public feeling, that advertisement shall not be displayed at the premises except with the consent in writing of the Licensing Authority.
17. Where the Licensing Authority have given notice in writing to the Licensee of the premises prohibiting the exhibition of a film on the ground that it contains matter which, if exhibited, would offend against good taste or decency or would be likely to encourage or incite to crime or to lead to disorder or to be offensive to public feeling, that film shall not be exhibited in the premises except with the consent in writing of the Licensing Authority.
18. For the purpose of this Licence "film" means any exhibition of moving pictures produced otherwise than by the simultaneous reception and exhibition of television programmes broadcast by the British Broadcasting Corporation or the Independent Broadcasting Authority or distibuted by a system licensed by The Secretary of State under Section 89 of the Post Office Act 1969.
19. Admissions to the premises shall be given at all times to the Police, Members and authorised Officers of the Licensing authority.
Appendix C
Additional Conditions as consistent with the Operating Schedule
1. The admission of children to films shall be restricted in accordance with the recommendations given either by the British Board of Film Classification (BBFC) or by the Licensing Authority.
2. When films are classified by either the BBFC or the Licensing Authority thay shall be classified in the following way:
U - Universal. Suitable for all
PG - Parental Guidance. Some scenes may be unsuitable for young children
12A - Passed only for viewing by persons aged 12 years and over or persons younger than 12 when accompanied by an adult.
15 - Passed only for viewing by persons aged 15 years and over.
18 - Passed only for viewing by persons aged 18 years and over.
3. Before the exhibition at the premises of a film passed by the BBFC there shall be exhibited on screen for at least five seconds in such a manner has to be easily read by all persons in the auditorium a reproduction of the certificate of the board or as regards a trailer advertising a film of the statement approved by the board indicating the classification of the film.
4. Where a programme includes film recommended by the Licensing Authority as falling into the 12A, 15 or 18 category no person appearing to be under the age of 12 and unaccompanied or under 15 or 18 as apprpriate shall be admitted to any part of the programme; and the license holder shall display in a conspicuous position a notice in the following terms:
"persons under the age of [ insert appropriate age] cannot be admitted to any part of the programme"
Where films of different categories form part of the same programme the notice shall refer to the oldest age restriction.
This condition does not apply to members of staff under the relevant age while on duty provided that the prior written consent by the persons, parent or legal guardian has first been obtained.
Attendants - premises without a staff alerting system
Where the premises are not equipped with a staff alerting system the number of attendants present should be as set out below.

2. Staff shall not be considered as being available to assist in the event of an emergency if they are:
2.1 the holder of the premise licence or the manager on duty at the premises; or
2.2 a member of stakk whose normal duties or responsibilities are likely to significantly affect or delay his response in an emergency situation; or
2.3 a member of staff whose usual location when on duty is more than 60 metres from the location to which he is required to go on being alerted to an emergency situation.
3. Attendants shall as far as reasonably practicable be evenly distributed throughout all parts of the premises to which the public have access and keep under observation all parts of the premises to which the audience have access.
4. The staff alerting system shall be maintained in working order.
