LICENSING ACT 2003
CONDITIONS ATTACHED TO THE GRANT OF THIS LICENCE
This licence is granted subject to any Mandatory Conditions imposed by the Licensing Act 2003, and conditions volunteered on the application form to be undertaken by the applicant and where necessary, conditions imposed by the Licensing Authority in order to promote the Licensing Objectives.
1. Mandatory Conditions:
a No supply of alcohol may be made under the Premises Licence at a time when there is no Designated Premises Supervisor (DPS) in respect of the Premises Licence OR at a time when the Designated Premises Supervisor does not hold a Personal Licence or his/her Personal Licence has been suspended.
b Every supply of alcohol under the Premises Licence must be made or authorized by a person who holds a Personal Licence.
c Any Door Security staff employed to carry out a security activity at the premises must be licensed with the Security Industry Authority (SIA).
d. In respect of the exhibition of films as mentioned below:
1 The admission of children to the exhibitions of any film is restricted as follows:
2 Where the film classification body is specified in the licence, unless 3(b) below applies, the admission of children is restricted in accordance with any recommendation of that body.
3 Where:-
(a) the film classification body is not specified in this licence, or
(b) the licensing authority has notified the holder of the licence that this subsection applies to the film in question,
the admission of children is restricted in accordance with any recommendation made by the licensing authority.
4 In relation to the above:
“children” means persons under the age of 18 years; and
“film classification body” means the persons or person designated as the authority under section 4 of the Video Recordings Act 1984.
Conditions Consistent with the Operating Schedule
1 The premises is to operate an effective CCTV system to be maintained in good working order at all times and of a type to be approved by the police. All recordings must be preserved for 28 days and produced to the police on request by a suitably trained member of staff. All staff will be trained to liase with the police in the event of disorder and will be sensitive to the concerns of local residents in this regard.
2 There will be a proper risk assessment in respect of fire safety carried out by the applicant. Staff will be trained in matters of fire safety. There will be on the premises an adequate and appropriate supply of first aid equipment.
3 Prominent, clear and legible notices will be displayed at the exit of the premises requesting all customers to respect the needs of local residents and to leave the premises and the area quietly.
4 There shall be provided at or near to the exit to the premises one waste bin to enable the disposal of waste food, food containers, wrappings and other waste items. At the end of trading each day all waste items will be cleared and placed in appropriate waste containers designed for that purpose.
5 There shall be no disposal or collection of refuse between 23.00 hours and 09.00 hours where such disposal would cause nuisance to local residents.
6 A scheme shall be submitted to the Licensing Authority and agreed with them to ensure that all fans or flues or other ventilation equipment shall meet the requirements of the Licensing Authority. The applicant will undertake to render all such equipment suitable to meet the requirements of the Licensing Authority.
7 The applicant will ensure that all staff are trained to have concern for the safety of children and will be particularly vigilant in serving young children unaccompanied late in the evening.
8. Mohammed Ghani to have no part in the management of Zaidys Limited or the licensed premises.
