CONDITIONS ATTACHED TO THE GRANT OF THIS LICENCE
This licence is granted subject to any Mandatory Conditions imposed by the Licensing Act 2003, and conditions volunteered on the application form to be undertaken by the applicant and where necessary, conditions imposed by the Licensing Authority in order to promote the Licensing Objectives.
Mandatory Conditions:
a No supply of alcohol may be made under the Premises Licence at a time when there is no Designated Premises Supervisor (DPS) in respect of the Premises Licence OR at a time when the Designated Premises Supervisor does not hold a Personal Licence or his/her Personal Licence has been suspended.
b Every supply of alcohol under the Premises Licence must be made or authorized by a person who holds a Personal Licence.
Mandatory Conditions pursuant to The Licensing Act 2003
Mandatory Licensing Conditions (Amendment) Order 2014
3. (1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.
(2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.
(3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either:
(a) a holographic mark, or
(b) an ultraviolet feature.
Definition:
Responsible person - as defined by section 153 (4) Licensing Act 2003 -
(a) In relation to a licensed premises -
(i) The holder of a premises licence in relation to a premise
(ii) The designated premises supervisor (if any) under such a licence.
(iii) Any individual aged 18 or over who is authorized for the purposes of this section by such a holder or supervisor.
(b) In relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables him to prevent the supply in question.
The Licensing Act 2003 (Mandatory Conditions) Order 2014
1. A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.
2. For the purposes of the condition set out in paragraph 1
(a) duty is to be construed in accordance with the Alcoholic Liquor Duties Act 1979
(b) permitted price is the price found by applying the formula
P = D +(D X V)
Where
(i) P is the permitted price,
(ii) D is the amount of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and
(iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;
(c) relevant person means, in relation to premises in respect of which there is in force a premises licence
(i) the holder of the premises licence,
(ii) the designated premises supervisor (if any) in respect of such a licence, or
(iii) the personal licence holder who makes or authorises a supply of alcohol under such a licence;
(d) relevant person means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and
(e) Value added tax means value added tax charged in accordance with the Value Added Tax Act 1994.
3. Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny.
4. (1) Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of paragraph2 on a day ( the first day ) would be different from the permitted price on the next day ( the second day ) as a result of a change to the rate of duty or value added tax.
(2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.
Conditions consistent with the Operating Schedule
General
TO PROMOTE ALL FOUR LICENSING OBJECTIVES WE WILL KEEP :
Strong management controls and effective training of all staff so that they are aware of the premises licence and the
requirements to meet the four licensing objectives with particular attention to :
a no selling of alcohol to underage people
b no drunk and disorderly behaviour on the premises or in the vicinity of the premises
c no violent and anti-social behaviour
d no any harm to children
- Operating Schedule providing the hours of operation and licensable activities during those hours.
- Designated premises supervisor to be in day-to-day control of the premises, to provide good training for staff on the
Licensing Act (training record), to make or authorise each sale.
-Clear “Challenge 25” information to prevent the supply of alcohol to under-age drinkers.
-CCTV system installed with recording option available.
-Fixed metal bars will be in place over window to ensure premises is safe and secure at all times.
As a licensed premises we know that it is necessary to carry our functions or operate our businesses with a purpose of
promoting these objectives. We promise to support these objectives through our operating schedules and other measures
(including staff training and qualifications, policies and strategic partnerships with other agencies)
The prevention of crime and disorder
1. We have CCTV cameras for the premises both internal and external.
2. All windows and doors are protected by roller shutters or fixed metal bars. The roller shutters are closed and locked at the end of the day.
3. We do not have any intention of allowing alcohol to be consumed on the premises by the general public and staff will betrained and briefed to ensure this does not happen, therefore do not foresee any disorder issues.
Public safety
4. The vast majority of transactions will be made online and delivery of the alcohol carried out by our distribution partners Royal Mail / DPD. However we will be offering an option for the general public to collect their alcohol purchases from the premises and as such we will ensure:
5.Well trained staff adherence to the environmental health requirements.
6. Training and implementation of underage ID checks.
7. A log book or recording system shall be kept upon the premises in which shall be entered particulars of inspections made,those required to be made statute and information complied to comply with public safety condition attached to the premises license that requires the recording of such information. A log book shall be kept available for inspection when required by persons authorised by the License Act 2003 or associated legislation.
8. All parts of the premises and all fittings and apparatus therein, door fastenings and notices, lighting, heating, electrical, aircondition, sanitary accommodation and other installations, will be maintained at all times in good order and in a safe condition.
The prevention of public nuisance
9. As previously stated we will not be allowing alcohol to be consumed by the general public on these premises, staff will be trained to ensure this does not happen and signs in and around the premises will advise the general public of this rule.
10. The general public will only ne able to collect their purchases during the designated hours of operation.
11. Deliveries of goods necessary for the operation of the business will be carried out at such a time or in such a manner as toprevent nuisance and disturbance to nearby residents.
12.The license will ensure that staff who arrive early morning or depart late at night (ex for unpacking, pricing newly delivered goods) when the business has ceased trading conduct themselves in such a manner to avoid causing disturbance to nearby residents.
13. Customers will not be asked to stand around loudly talking in the street outside the premises.
14. Customers will not be admitted to the premises outside of the opening hours which will be clearly displayed.
The protection of children from harm
15. Our terms and conditions state alcohol deliveries can not be left with any individual who can not show proof of being 18 years or older. We have specifically selected Royal Mail and DPD as our distribution partners as they have experience in delivering alcohol for other online businesses, they can not leave alcohol with anyone who cannot prove their ages, if thecustomer can not prove their age if challenged by the delivery driver the goods will be returned by them to our business.
16. With regards to any customer who wishes to collect from our depot:“Challenge 25” sign which is a retailing strategy that encourages anyone who is over 18 but looks under 25 to carry acceptable ID (a card bearing the PASS hologram, a photographic driving license or a passport) if they wish to buy alcohol.
17. We will train staff about requirement for persons identification, age establishment etc.
18. All the details provided in Training Record Book available in the retail unit.
19. Logbook will be kept upon the premises all the time.
20. In terms of delivery we expressly state that parcels can not be left with any under the age of 18 and courier delivery drivers are aware of this.
