CONDITIONS ATTACHED TO THE GRANT OF THIS LICENCE
This licence is granted subject to any Mandatory Conditions imposed by the Licensing Act 2003, Embedded Conditions carried across on conversion of your previously held Justices Licence, Conditions Converted from any previously held Public Entertainments Licence, Conditions volunteered on the application form to be undertaken by the applicant and where necessary, Conditions imposed by the Licensing Authority in order to promote the Licensing Objectives.
1. Mandatory Conditions:
a No supply of alcohol may be made under the Premises Licence at a time when there is no Designated Premises Supervisor (DPS) in respect of the Premises Licence OR at a time when the Designated Premises Supervisor does not hold a Personal Licence or his/her Personal Licence has been suspended.
b Every supply of alcohol under the Premises Licence must be made or authorized by a person who holds a Personal Licence.
c Any Door Security staff employed to carry out a security activity at the premises must be licensed with the Security Industry Authority (SIA).
d. In respect of the exhibition of films as mentioned below:
1 The admission of children to the exhibitions of any film is restricted as follows:
2 Where the film classification body is specified in the licence, unless 3(b) below applies, the admission of children is restricted in accordance with any recommendation of that body.
3 Where:-
(a) the film classification body is not specified in this licence, or
(b) the licensing authority has notified the holder of the licence that this subsection applies to the film in question,
the admission of children is restricted in accordance with any recommendation made by the licensing authority.
4 In relation to the above:
“children” means persons under the age of 18 years; and
“film classification body” means the persons or person designated as the authority under section 4 of the Video Recordings Act 1984.
Conditions consistent with the Operating Schedule
1 The premises will operate a CCTV system consisting of adequate cameras and a 40 day digital recording media. The CCTV will be operating at all times the premises are open to the public.The system will cover the public areas of the premises and will capture a clear head and shoulders view of the persons entering the premises. The system will be maintained in proper working order and CCTV signage will accompany the system indicating that CCTV is in operation in the premises.
2 There will be a zero tolerance drugs policy at the premises.
3 SIA door staff will be on duty on Thursdays, Fridays and Saturdays following a risk assessment by the DPS/responsible person.
4 A record shall be kept on the premises by the DPS of every door supervisor employed on the premises. The record shall contain the following details (i) name and address, (ii) date of birth, (iii) SIA licence number and (iv) time commenced duty and time terminated duty. Records shall be available for inspection on demand by an authorised person, the SIA or a Police Officer.
5 The premises will be subject to risk assessment under the Regulatory Reform (Fire Safety) Order 2005 from which a maximum safe capacity will be determined. Door Supervisors will ensure that no customer shall enter or leave the premises from/to the public highway or public place with any open bottle, glass or container except by way of trade delivery.There will be frequent collections of drink containers and glassware to avoid accumulation. Glasses will be toughened where commercially available.
6 The licence holder or his representative shall conduct regular assessments of the noise coming from the premises on every occasion the premises are used for regulated entertainment and shall take steps to reduce the level of noise where it is likely to cause a disturbance to local residents. There shall be placed at all exits from the premises in a place where they can be easily seen, notices requiring customers to leave the premises quietly when regulated entertainment is taking place. External doors and windows shall be closed at all times except for the purposes of access or egress in an emergency.
7 Children will not be permitted on the premises after 18.00 hours unless attending a pre-arranged function.
8 Persons who appear to be under the age of 21 years shall be required to produce proof of age under the Challenge 21 scheme. Challenge 21 posters/notices will be prominently displayed at the premises.
Non Standard Timings
For all activities included in the licence - an extra hour on all public holidays, Christmas, Boxing Day, New Year and British Summer Time.
Conditions imposed at a Review Hearing 10 February 2010
1. That Mr Jack Harris, the present Designated Premises Supervisor be removed from the Premises Licence in that role.
2. The premises is required to operate an effective CCTV system which is to be maintained in good working order at all times the premises is open for business. The type of system and the number / positioning of cameras is to be agreed in liaison with the police. The recording medium (e.g. discs / tapes / hard drive etc) are to be retained and securely stored for a minimum period of 28 days and are to be made available to the police / Authorised Officers of the Licensing Authority upon request. The premises licence holder is to provide the police with the contact details of at least two members of staff (or other person(s) ) who are trained and familiar with the operation of the equipment so that, at the expense of the premises licence holder, they are able to check that the equipment is operating properly and that they are able to provide copies of the recorded data upon request and within no more than 12 hours from the time of the request. Police and Licensing Authority to be notified of any breakdown as soon as reasonably practicable.
3. A personal licence holder must be on the premises from 9pm until closing Thursdays, Fridays, Saturday, Sundays weekly and on all public holidays; at all other times an authorisation form with a list of those employees who have been authorised by the DPS to sell alcohol at the licensed premises should be kept at the said premises and be made available for inspection by the police and authorised officers of the licensing authority on request.
4. A daily log will be maintained at the premises showing the details of the Door Security. Staff on duty and the details of any incidents that take place. The log will be made available to the Police, to SIA inspectors & to Authorised Officers of the Licensing Authority on request.
5. Customers are not allowed to leave the premises with drinking glasses and open bottles.
6. To remove the Condition “There will be zero tolerance drugs policy at the premises” and replace with:-
“There will be zero tolerance drugs policy in the premises and regular checks of the premises will be made and a record of the checks will be kept and produced to the Police or any authorised person”.
7. To promote the prevention of Crime & Disorder licensing objectives the premises will participate in the recognised Bury Town Centre radio communications system agreed by the Police. The designated premises supervisor is to ensure that staff are trained on the operation of the radios and the equipment is maintained.
8. That no advertisements or other signs be erected by any person connected with the Premises that would obstruct the view from CCTV equipment outside the premises. This needs to include removal of the existing obstructing advert.
9. The hours of operation be altered to ensure that all licensable activities cease at 2am (Monday-Sunday) and that the premises close by 2.15am (Monday-Sunday).
