CONDITIONS ATTACHED TO THE GRANT OF THIS LICENCE
This licence is granted subject to any Mandatory Conditions imposed by the Licensing Act 2003, Embedded Conditions carried across on conversion of your previously held Justices Licence, Conditions Converted from any previously held Public Entertainments Licence, Conditions volunteered on the application form to be undertaken by the applicant and where necessary, Conditions imposed by the Licensing Authority in order to promote the Licensing Objectives.
1. Mandatory Conditions:
a No supply of alcohol may be made under the Premises Licence at a time when there is no Designated Premises Supervisor (DPS) in respect of the Premises Licence OR at a time when the Designated Premises Supervisor does not hold a Personal Licence or his/her Personal Licence has been suspended.
b Every supply of alcohol under the Premises Licence must be made or authorized by a person who holds a Personal Licence.
c Any Door Security staff employed to carry out a security activity at the premises must be licensed with the Security Industry Authority (SIA).
d. In respect of the exhibition of films as mentioned below:
1 The admission of children to the exhibitions of any film is restricted as follows:
2 Where the film classification body is specified in the licence, unless 3(b) below applies, the admission of children is restricted in accordance with any recommendation of that body.
3 Where:-
(a) the film classification body is not specified in this licence, or
(b) the licensing authority has notified the holder of the licence that this subsection applies to the film in question,
the admission of children is restricted in accordance with any recommendation made by the licensing authority.
4 In relation to the above:
“children” means persons under the age of 18 years; and
“film classification body” means the persons or person designated as the authority under section 4 of the Video Recordings Act 1984.
Embedded Conditions - Justices’ On and Off Licence (not having a Children’s Certificate)
1 Permitted hours. Alcohol shall not be sold or supplied except during permitted hours.
In this condition, permitted hours means:
(1) On New Years Eve from the end of permitted hours on New Years Eve to the start of permitted hours on the following day (or, if there are no permitted hours on the following day, midnight on the 31st December)
The above restrictions do not prohibit
(a) the consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;
(b) the ordering of alcohol to be consumed off the premises, or the despatch by the vendor of the alcohol so ordered;
(c) the sale of alcohol to a trader or club for the purposes of the trade or club;
(d) the sale or supply of alcohol to any canteen or mess, being a canteen in which the sale or supply of alcohol is carried out under the authority of the Secretary of State or an authorised mess of members of Her Majesty’s naval, military or air forces;
(e) the taking of alcohol from the premises by a person residing there; or
(f) the supply of alcohol for consumption on the premises to any private friends of a person residing there who are bona fide entertained by him at his own expense, or the consumption of alcohol by persons so supplied; or
(g) the supply of alcohol for consumption on the premises to persons employed there for the purposes of the business carried on by the holder of the licence, or the consumption of liquor so supplied, if the liquor is supplied at the expense of their employer or of the person carrying on or in charge of the business on the premises.
(h)during the first twenty minutes after the above hours, the taking of alcohol from the premises unless the alcohol is supplied or taken in an open vessel.
2. The relaxation provisions in section 182 Licensing Act 1964 shall apply in relation to the provision of public entertainment in the premises by the reproduction of wireless (including television) broadcasts or music and singing solely provided by the reproduction of recorded sound.
Conditions consistent with the Operating Schedule
1 The maximum number of persons, including staff, allowed in the licensed area of the premises shall be 100 subject to a risk assessment under the Fire Safety Order 2005 determining a lesser capacity.
2 The licence holder shall be a member of Pub Watch schemes for the area within which the premises is located. The DPS shall regularly attend meetings of the scheme and if not available, another person nominated by them should attend such meetings. The premises will comply with the rules of the scheme in relation to not allowing admission to known persons on the banned list of such a scheme.
3 On the advcie of the Police on the occasion of a local sporting fixture or other event where disorder is anticipated, the premises will voluntarily close without the requirement for a closure order.
4 Whenever a DPS is not at the premises, another individual must be nominated as being the reponsible person nominated by the DPS to manage the premises and they must have the contact details of the DPS.
5 When disabled persons are present on the premises there shall be in place arrangements for their safe evacuation in the case of an emergency or other reason. Details of those arrangements shall be recorded in writing and all staff employed on the premises shall be aware of those arrangements.
6 All exits and escape routes to those exits (including external escape routes) from the premises shall be provided with non-slip even surfaces and shall be maintained in good repair, correct working order and kept free from all obstructions when the public are on the premises. External escape routes shall also be kept free from ice and snow.
7 All exit routes and doors on such routes shall be checked on every occasion before the premises is used for purposes of a licensable activity and at regular occasions when the premises are open to the public to ensure that they are free from defect, obstruction, trip hazards and surfaces are not slippery.
8 There shall be maintained on the premises at all times an adequate and appropriate supply of first aid equipment and materials.
9 No dry ice machines or cryogenic fog, smoke machines or fog generators shall be used at the premises.
10 No strobe light shall be used in premises unless a notice which can be clearly seen and easily read by the public warning that strobe lights are in use in the premises is displayed at each entrance to the premises.
11 There shall be regular collections of drinking vessels in order that no accumulation of glassware shall occur.
12 There shall be placed at all exits from the premises in a place where they can be seen and easily read by the public, notices requiring customers to leave the premises and the area quietly.
13 Where there is live music and at any other appropriate time announcements will be made requesting patrons to respect the neighbourhood and leave the premises and area quietly.
14 The placing of refuse, such as bottles, into receptacles outside the premises shall not take place between 2300 hours and 0700 hours, having regard to the application, so as to prevent disturbance to nearby premises.
15 No statutory nuisance shall be caused at noise sensitive premises by noise coming from the premises or by vibration transmitted through the structure of the premises.
16 All external doors and windows shall be kept closed when regulated entertainment is being provided except in the event of an emergency or during immediate access or egress.
17 No regulated entertainment from within the premises shall be transmitted outside the premises by the use of speakers or other means.
18 The exterior areas of the premises which trade as part of the premises shall not be used for the consumption of alcohol after 2300 hours.
19 Any exterior music which is not regualted under Schedule 1 Licensing Act 2003 shall not take place after 2200 hours.
20 There shall be placed at all exits from the premises in a place where they can be seen and easily read by the public notices advising patrons that no alcoholic drinks should be taken outside the premises after 2300 hours each day in unsealed containers.
21 The licence holder or his representative shall conduct regular assessments of the noise coming from the premises on every occasion the premises are used for regulated entertainment and shall take steps to reduce the level of noise where it is likely to cause a disturbance to local residents. A written record shall be made of those assessments in a log book kept for that purpose and shall include, the time and date of the checks, the person making them and the results including any remedial action. This book shall also contain details of noise complaints made and remedial action.
22 Local residents in the terraced properties adjoining the premises shall be furnished with the telephone contact number of the premises who can be contacted should they experience nuisance.
23 The premises external areas shall be kept clean and tidy so as not to be a cause of nuisance.
24 There shall be in place for the premises a written policy to prevent the sale or supply of alcohol to persons under 18 years of age. That policy shall require any person who appears to be under the age of 18 years to produce one of the following forms of identification:
- a recognised proof of age card accredited under the British Retail Consortiums Proof of Age Standards Scheme (PASS).
- photo driving licence
- passport
- citizen card supported by the Home Office
- official ID card issued by HM Forces or EU bearing a photograph and birth date of the holder.
25 A notice or notices shall be displayed in and at the entrance to the premises where they can be clearly seen and read and shall indicate that it is unlawful for persons under 18 to purchase alcohol or for any person to purchase alcohol on behalf of a person under 18 years of age.
26 BBPS Challenge 21 posters shall be prominently displayed in the premises.
27 Noise from any entertainment will be generally inaudible from the nearest noise sensitive building.
