LICENSING ACT 2003
CONDITIONS ATTACHED TO THE GRANT OF THIS LICENCE
This licence is granted subject to any Mandatory Conditions imposed by the Licensing Act 2003, and conditions volunteered on the application form to be undertaken by the applicant and where necessary, conditions imposed by the Licensing Authority in order to promote the Licensing Objectives.
Mandatory Conditions:
a No supply of alcohol may be made under the Premises Licence at a time when there is no Designated Premises Supervisor (DPS) in respect of the Premises Licence OR at a time when the Designated Premises Supervisor does not hold a Personal Licence or his/her Personal Licence has been suspended.
b Every supply of alcohol under the Premises Licence must be made or authorized by a person who holds a Personal Licence.
4. (1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
Definition:
Responsible person - as defined by section 153 (4) Licensing Act 2003 -
(a) In relation to a licensed premises -
(i) the holder of a premises licence in relation to a premises
(ii) the designated premises supervisor (if any) under such a licence
(iii) any individual aged 18 or over who is authorised for the purposes of this section by such a holder or supervisor.
(b) In relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables him to prevent the supply in question.
Conditions consistent with the Operating Schedule
Conditions:
1/ The premise is to operate a CCTV system which is to be maintained in good working order at all times the premises is open for business, The recording medium (e.g. discs / tapes / hard drive etc) and associated images are to be retained and securely stored for a minimum period of 28 days and are to be made available to the police / authorised officers of the Licensing Authority upon request. A member of staff trained in the use of the CCTV system must be available (but not necessarily at the premises) at all times that the premises are open to the public to provide copies of data, at the premise licence holders expense, upon request and within no more than 24 hours from the time of the request. The Premise Licence Holder must notify the licensing office or the police in any event of CCTV breakdown or malfunction as soon as is reasonably practical and in any event within 24hrs.
A minimum of 3 cameras are to be utilised within the unit as detailed: Public Entry / Exit point to cover facial recognition. Manufacturing Entry / Exit Point and the rear wall of the public are behind the service window / counter.
2/ All staff engaged or to be engaged in the sale of alcohol on the premises shall receive the following training in age restricted sales (which shall include training on alcohol licensing legislation and the licensing objectives):
·Induction training which must be completed and documented prior to the sale of alcohol by the staff member.
·Refresher/reinforcement training at intervals of no more than 6 months.
Training records will be available for inspection by a police officer or other authorised officer of the Council on request.
3/ Members of the public must not have access to the manufacturing / premises stock / storage areas.
4 / No external signage or advertising displays are to be placed outside the premises or near to the premises (other than one small sign identifying the premises as ‘Red Bank Cider’ over the public entry door no larger than 100cm x 25cm)
5 /The premises licence holder will operate a Challenge 25 proof of age policy and signage to this effect will be prominently displayed within the premises. Persons who appear to be under the age of 25 must produce for thorough scrutiny by staff, proof of identity/age before being sold / supplied alcohol. Only a passport or photo-card driving licence or a proof of age card bearing the official ‘PASS’ accreditation hologram should to be accepted as proof of age.
6/ All sales assistants shall be trained to record refusals of sales of alcohol in a refusals book/register. The book/register will contain:
details of the time and date the refusal was made;
the identity of the staff member refusing the sale;
details of the alcohol the person attempted to purchase.
description of the person attempting to purchase alcohol.
This book/register will be available for inspection by a police officer or other officer of the Council on request.
7/ To prevent any telephone, on line / internet alcohol purchases by underage persons. The company will operate a proof of age (over 18) declaration system for all purchases and a record of this declaration will be kept for all, on line and internet purchases and sales. This to be clearly advertised on the website.
