LICENSING ACT 2003
CONDITIONS ATTACHED TO THE GRANT OF THIS LICENCE
This licence is granted subject to any Mandatory Conditions imposed by the Licensing Act 2003, and conditions volunteered on the application form to be undertaken by the applicant and where necessary, conditions imposed by the Licensing Authority in order to promote the Licensing Objectives.
1. Mandatory Conditions:
a No supply of alcohol may be made under the Premises Licence at a time when there is no Designated Premises Supervisor (DPS) in respect of the Premises Licence OR at a time when the Designated Premises Supervisor does not hold a Personal Licence or his/her Personal Licence has been suspended.
b Every supply of alcohol under the Premises Licence must be made or authorized by a person who holds a Personal Licence.
c Any Door Security staff employed to carry out a security activity at the premises must be licensed with the Security Industry Authority (SIA).
d. In respect of the exhibition of films as mentioned below:
1 The admission of children to the exhibitions of any film is restricted as follows:
2 Where the film classification body is specified in the licence, unless 3(b) below applies, the admission of children is restricted in accordance with any recommendation of that body.
3 Where:-
(a) the film classification body is not specified in this licence, or
(b) the licensing authority has notified the holder of the licence that this subsection applies to the film in question,
the admission of children is restricted in accordance with any recommendation made by the licensing authority.
4 In relation to the above:
“children” means persons under the age of 18 years; and
“film classification body” means the persons or person designated as the authority under section 4 of the Video Recordings Act 1984.
2. Additional Mandatory Conditions pursuant to The Licensing Act 2003 (Mandatory Licensing Conditions) Order 2010,
(1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
(2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-
(a) Games or other activities which require or encourage, or are designed to require or encourage, individuals to-
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or
supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;
(d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-
(i) the outcome of a race, competition or other event or process, or
(ii) the likelihood of anything occurring or not occurring;
(e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.
3. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).
4. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.
5. The following two conditions take effect as from 1st October 2010.
(1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.
(2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.
6. The responsible person shall ensure that-
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml;
(iii) still wine in a glass: 125 ml; and
(b) customers are made aware of the availability of these measures.
7. Definition:
Responsible person - as defined by section 153 (4) Licensing Act 2003 -
(a) In relation to a licensed premises -
(i) the holder of a premises licence in relation to a premises
(ii) the designated premises supervisor (if any) under such a licence
(iii) any individual aged 18 or over who is authorised for the purposes of this section by such a holder or supervisor.
(b) In relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables him to prevent the supply in question.
Conditions Consistent with the Operating Schedule
General
The sale of alcohol under this premises licence shall be restricted to persons who have purchased tickets for a concert or other similar large scale form of entertainment being held at the premises.
No large scale concert involving live amplified music shall last longer than a period of 11 hours.
The premises licence holder shall provide Environmental Health with the name and contact telephone number of a responsible person (or persons) who can be contacted throughout the duration of any large scale concert
or other similar large scale form of entertainment. This person (or persons) will be the premises licence holder’s representative and premises licence holder’s contact with Environmental Health throughout the duration of the
event
No persons carrying open or sealed bottles/cans shall be admitted to the premises at any time the premises are open to the public. Checks will be carried out by members of staff on all persons before admittance to the
premises is granted and any open or sealed bottles found will be confiscated - signs will be displayed to this effect.
Large scale concerts or other similar large scale forms of entertainment shall not be held on more than 10 days in any one calendar year;
The organiser will obtain completion certificates for all temporary structures, power and water installations prior to the event opening to the public.
The organiser will hold both public and employers liability insurance to a total of 10 million pounds for each event.
The security company will produce a dedicated crowd management plan with flow in mind and the security team briefed to prevent over crowding in audience areas and will be signed off by ESAG one month prior to the event.
The level of all professional security personnel, approved in relation to the event by the licensing authority, will have a designated responsibility to maintain a safe environment for all members of the public attending the
event. SIA registered supervisors will be positioned at entrance gates, bars, stages and will patrol during each event.
Additional stewarding staff will provide support, monitoring other areas and patrolling the event. Stewards will be easily identifiable and have appropriate training for their duties.
All event activity within the premises will be controlled with specific reference to the capacity of the venue, the nature of the event content and in compliance with the standards for the provision of services as required by
current legislation.
The organiser will employ the services of a first aid provider; A dedicated and clearly signed first aid point will be manned at all times that the premises are open to the public.
A dedicated blue route will be indicated in the Traffic Management Plan and be kept clear for access by emergency vehicles at all times.
No glass containers, glass bottles or cans shall be sold on the premises. The event organiser shall also take appropriate measures to prevent glass containers, glass bottles or cans being brought onto the premises by the
public.
The Organiser shall ensure that adequate sanitary provisions, hand washing and drying facilities are provided for the number of people expected to attend the event and be proportional to the gender split and audience
profile.
The organiser shall prepare an Emergency Plan to respond to all foreseeable major incidents occurring on site.
The plan is inclusive of evacuation procedures and will be prepared in consultation with emergency services to enable quick and effective action to be implemented by the license holder and emergency services in the event
of a major incident.
The organiser will appoint a recognised noise consultant for the event.
For the purpose of monitoring music noise levels during concert events and sound checks the noise consultant shall contact Environmental Health and agree noise sensitive locations which are to be used to monitor sound
levels from event.
A recognised waste management company will be appointed to collect litter during and after the event. A waste management plan will be circulated to the ESAG group. The organiser will identify an area outside the
Licensed Premises for the collection of litter of patrons leaving the premises.
Prevention of Crime and Disorder
Whenever the premises are used for licensable activities under this premises licence, a digital hard drive CCTV shall be in use. All CCTV recorded images shall have sufficient clarity, quality and definition to provide facial
recognition. The CCTV images shall be kept in an unedited format for a period of 28 days and any DVD subsequently produced shall be in a format so that it can be played back on a standard personal computer or
DVD player. A nominated person or persons, trained in the use of such CCTV equipment, must be able to download, produce or burn the CCTV images upon request by an authorized representative of a responsible
authority. The CCTV system shall be maintained on a regular basis and kept in good working order with CCTV maintenance records kept with details of any contractor used or any work carried out.
Procedures as used on Match days will be in use regarding entry searches/drug dogs.
Public Safety
The licensee must complete a full Health and Safety Event Plan prior to each event. This H&S Plan must be signed off by ESAG one month prior to the event.
Notices detailing the actions to be taken in the event of a fire or other emergencies, including how the fire brigade shall be summoned, are to be prominently displayed.
The organisers of any large scale concert or other similar large scale form of entertainment shall conduct the event in line with any requirements drawn up in conjunction with SAG.
The event organisers shall ensure appropriate levels of health and safety for workers and visitors on the site during any sound checks and during any large scale concert and, for the safety of the
audience, the event organisers shall arrange for a noise assessment having regard to current HSE Guidance.
The premises licence holder shall provide an adequate number of volunteers within the Ground to direct ticket holders attending the event.
Full details and risk assessments of any special effects to be used during any large scale concert or other similar large scale form of entertainment shall be submitted to Environmental Health. Special Effects will include
any pyrotechnics, Liquid Petroleum Gas effects, lasers, strobe effects, smoke effects and dry ice etc.
A sufficient number of SIA licensed stewards will be employed to supervise the licensable activities taking place both inside the stadium and the licensed areas surrounding it. The number of such stewards required for each
event will be assessed by the premises licence holder on an event by event basis and will be agreed with the Greater Manchester Police.
All drinks will be decanted into or served in non-glass receptacles for consumption. The use of glass will not be permitted for the consumption of drinks in any of the licensed areas.
The prevention of public nuisance
The organiser will employ the services of a noise consultant to produce a noise management plan to be signed off by ESAG one month prior to the event.
Sound checks are only permitted between the hours of 0900 to 2100 Monday to Saturday and 1000 to 1800 on Sunday.
At least 48 hours notice shall be given, where practicable, of the date and time of sound checks in order for Environmental Health to make arrangements for synchronous noise monitoring measuring.
All plant and equipment sited externally to the main stadium shall be placed and operated in a manner that does not cause noise nuisance to nearby residents, with particular regard to any noisy plant operating during night
time hours.
No amplified musical entertainment and/or pyrotechnic effects shall take place on the premises after 2300 hours.
The premises licence holder shall ensure that suitable provision is provided for the clean up of litter and rubbish outside the stadium and immediate surrounding areas.
A plan to manage the dispersal of those attending any large scale concert or other similar large scale form of entertainment shall be agreed in conjunction with Greater Manchester Police.
Specified car parks will be available for use by persons attending events.
Licensee to arrange notification/liasing with Metrolink and local bus services a minimum of 28 days prior to each event.
The protection of children from harm
Training will be provided to all staff who are responsible for the sale of alcohol, including all staff employed by any outside contractors, to refuse to serve alcohol to anyone who appears to be drunk.
Careful planning of the supply of alcohol in conjunction with responsible authorities will include controls to prevent excessive drinking and the supply of alcohol to minors. The organisers will operate a Challenge 25
policy on the sale of alcohol. Anyone who appears to be under the age of 25 will be asked to produce identification.
All bar staff shall be trained in regards to the Challenge 25 policy. This training will be recorded in writing and be made available upon request.
Sufficient numbers of bar staff will be employed in order to keep down the number of people waiting at any bar area. Staff will be moved between bars or shifts altered during the event if required in response to demand.
SIA security staff will be briefed to be on the lookout for minors consuming alcohol. Notices will be clearly displayed at bars indicating that it is unlawful for persons under 18 to purchase alcohol or purchase alcohol on
behalf of a person under 18 years of age.
A refusal log will be kept at each bar.
The Premises is to operate a "Challenge 25" proof of age policy and signage to this effect will be prominetnly displayed within the premises. Persons who appear to be under the age of 25 must produc for through scutiny, proof of identity/age before being sold/supplied alcohol. Only a passport or photo-card driving licence or a proof of age card bearing the offical "PASS" should be accepted as proof of age.
The premises will maintain a refusals book to record the details of incidents/descriptioms of indiviuals whenever a member of staff has refused to sell alcohol to a person suspected of being under the age of 18. The book will be made available to the police/authorised officers of the Licensing Authority request.
