LICENSING ACT 2003
CONDITIONS ATTACHED TO THE GRANT OF THIS LICENCE
This licence is granted subject to any Mandatory Conditions imposed by the Licensing Act 2003, and conditions volunteered on the application form to be undertaken by the applicant and where necessary, conditions imposed by the Licensing Authority in order to promote the Licensing Objectives.
1. Mandatory Conditions:
a No supply of alcohol may be made under the Premises Licence at a time when there is no Designated Premises Supervisor (DPS) in respect of the Premises Licence OR at a time when the Designated Premises Supervisor does not hold a Personal Licence or his/her Personal Licence has been suspended.
b Every supply of alcohol under the Premises Licence must be made or authorized by a person who holds a Personal Licence.
c Any Door Security staff employed to carry out a security activity at the premises must be licensed with the Security Industry Authority (SIA).
d. In respect of the exhibition of films as mentioned below:
1 The admission of children to the exhibitions of any film is restricted as follows:
2 Where the film classification body is specified in the licence, unless 3(b) below applies, the admission of children is restricted in accordance with any recommendation of that body.
3 Where:-
(a) the film classification body is not specified in this licence, or
(b) the licensing authority has notified the holder of the licence that this subsection applies to the film in question,
the admission of children is restricted in accordance with any recommendation made by the licensing authority.
4 In relation to the above:
“children” means persons under the age of 18 years; and
“film classification body” means the persons or person designated as the authority under section 4 of the Video Recordings Act 1984.
Appendix A
Conditins Consistent with the Operating Schedule
1. Digital CCTV to be installed and maintained on a 24 hour basis. Till points will be monitored by the CCTV. Data will be retained for a period of 31 days and will be made available to the police upon request.
2. Sales of alcohol for consumption on the premises will be confined to the cafe. The cafe will only be made available to customers when the store is open and no sale of alcohol will be made from the cafe after 23.00pm on Mondays to Saturdays and after 22.30pm on Sundays.
3. Fire safety measures and procedures will be in operation at the store and in accordance with Fire Safety
Regulations. Provisions will be made for the disabled to ensure safe evacuation in the event of fire or other emergency and general access to the store.
4. All planning requirements will be met and procedures established to prevent noise nuisance from deliveries and machinery.
6. Measures will be in place to ensure the proper disposal of all waste and the company's stores are registered under the Environmental Agency Scheme.
7. Staff to be trained to ensure that in case of any doubt whether a purchaser is over the age of 18 to refuse sale of alcohol unless valid identification is produced.
8. Till prompts remind staff at point of sale of alcohol to ensure the purchaser is over 18 years of age.
9. Signs will be displayed to advise purchasers that it is an offence to purchase alcohol under 18 years of age.
10.The premises is to operate an Age Challenge Scheme with an Age Challenge of not less than 21 (currently 25) years of age ("the minimum age"). Persons who appear to be under the minimum age must produce valid proof of age showing they are 18 or over for thorough scrutiny before alcohol is sold. Only a passport, photo-card driving licence and ID with PASS logo will be accepted as valid proof of age. Signage to this effect will be displayed on the premises.
