LICENSING ACT 2003
CONDITIONS ATTACHED TO THE GRANT OF THIS LICENCE
This licence is granted subject to any Mandatory Conditions imposed by the Licensing Act 2003, and conditions volunteered on the application form to be undertaken by the applicant and where necessary, conditions imposed by the Licensing Authority in order to promote the Licensing Objectives.
1. Mandatory Conditions:
a No supply of alcohol may be made under the Premises Licence at a time when there is no Designated Premises Supervisor (DPS) in respect of the Premises Licence OR at a time when the Designated Premises Supervisor does not hold a Personal Licence or his/her Personal Licence has been suspended.
b Every supply of alcohol under the Premises Licence must be made or authorized by a person who holds a Personal Licence.
c Any Door Security staff employed to carry out a security activity at the premises must be licensed with the Security Industry Authority (SIA).
d. In respect of the exhibition of films as mentioned below:
1 The admission of children to the exhibitions of any film is restricted as follows:
2 Where the film classification body is specified in the licence, unless 3(b) below applies, the admission of children is restricted in accordance with any recommendation of that body.
3 Where:-
(a) the film classification body is not specified in this licence, or
(b) the licensing authority has notified the holder of the licence that this subsection applies to the film in question,
the admission of children is restricted in accordance with any recommendation made by the licensing authority.
4 In relation to the above:
“children” means persons under the age of 18 years; and
“film classification body” means the persons or person designated as the authority under section 4 of the Video Recordings Act 1984.
Appendix A
Conditions consistent with the Operating Schedule
1. Nuisance at the premises will not be tolerated and underage sales of all types of product will be strictly avoided.
2. The DPS to maintain a notice of authority book for all staff to sell alcohol. All staff to sign on and off each time they work
3. CCTV system installed and maintained and operated at the premises. All CCTV images to be kept for 28 days and made available to Police under request. A panic alarm system shall be installed and maintained on the premises.
4. Clear and prominent notices shall be displayed highlighting the danger of drink driving. Also signs will be displayed stating that anti-social behaviour will not be tolerated.
5. No alcohol will be dispensed unless it is in a sealed container.
6. Management and staff will ensure that the premises will remain free from debris and litter on a regular basis.
7. Effective lighting inside and outside the premises will be maintained. Regular fire assessments will be carried out.
8. Staff will ensure that alcohol is not supplied to any customers who have consumed excessive alcohol.
9. Staff will not permit groups to congregate inside or outside the premises.
10. Management and Staff will ensure that noise from the premises will not cause nuisance.
11. A 'challenge 21' policy will be operated. Only photo ID eg. Driving Licence/Passport will be accepted.
12. Staff will be fully trained in relation to the sales of alcohol and age restricted products. Quarterly documented knowledge checks to be implemented. Staff to be trained to be vigilant against persons over the age of 18 seeking to purchase alcohol for a person who is underage. All staff to be supervised when serving alcohol, asking for and checking ID.
13. A refusal of sale log will be maintained and made available to the responsible body.
