LICENSING ACT 2003
CONDITIONS ATTACHED TO THE GRANT OF THIS LICENCE
This licence is granted subject to any Mandatory Conditions imposed by the Licensing Act 2003, and conditions volunteered on the application form to be undertaken by the applicant and where necessary, conditions imposed by the Licensing Authority in order to promote the Licensing Objectives.
1. Mandatory Conditions:
a No supply of alcohol may be made under the Premises Licence at a time when there is no Designated Premises Supervisor (DPS) in respect of the Premises Licence OR at a time when the Designated Premises Supervisor does not hold a Personal Licence or his/her Personal Licence has been suspended.
b Every supply of alcohol under the Premises Licence must be made or authorized by a person who holds a Personal Licence.
c Any Door Security staff employed to carry out a security activity at the premises must be licensed with the Security Industry Authority (SIA).
d. In respect of the exhibition of films as mentioned below:
1 The admission of children to the exhibitions of any film is restricted as follows:
2 Where the film classification body is specified in the licence, unless 3(b) below applies, the admission of children is restricted in accordance with any recommendation of that body.
3 Where:-
(a) the film classification body is not specified in this licence, or
(b) the licensing authority has notified the holder of the licence that this subsection applies to the film in question,
the admission of children is restricted in accordance with any recommendation made by the licensing authority.
4 In relation to the above:
“children” means persons under the age of 18 years; and
“film classification body” means the persons or person designated as the authority under section 4 of the Video Recordings Act 1984.
Appendix A
Conditions Consistent with the Operating Schedule
1. I will undertake, record, monitor and review Risk Assessments for all activities, events and functions held at the premises.
2. Staff to receive appropriate training, and all staff (permanent, temporary, agency or voluntary) & contractors will receive induction on Health & Safety, emergency procedures & the outcomes of risk assessments relating to their activities.
3. Sale of Alcohol will be principally as part of the catering activities, served with food, and as a gift item within the retail area for off sales.
4. CCTV equipment to record from the time that the premises open to the public until the premises close and all members of the public have left. Notices advising CCTV installed to be clearly visible to members of the public.
5. A panic button to be linked to the local Police Station in case of emergency.
6. Ensure that receptacles for waste are emptied regularly to minimise nuisance and smells. To make sure litter is regularly cleared from the vicinity.
7. All emergency lighting, fire exits, escape routes, fire safety equipment including fire alarms, electrical and gas installations should be regularly checked to ensure that they are properly maintained and in good working order.
8. Escape routes and exits, including external exits are to be maintained to ensure they are not obstructed, free from hazards, in good order and clearly identified.
9. All exit doors to be regularly checked & a log kept. to make sure exit doors are not held open other than by approved devices (eg. electromagnetic releases operated by smoke detectors).
10. Prominent, clear and legible notices should be displayed at all exits requesting that customers respect the need of local residents and to leave the premises and area quietly.
11. Any music and noise shall be generally inaudible inside noise sensitive property at any time and noise levels should be regularly checked. All external doors and windows shall be kept closed when regulated entertainment is being provided except in the event of an emergency or during immediate access or egress.
12. One person to be responsible for monitoring noise levels and they will be instructed to implement any changes in accordance with any request by an authorised officer of the council immediately and ensure that volume is maintained at the reduced level.
13. To implement a proof of age policy agreed by the police and local authority. To familiarise staff with the Portman Groups Leaflet 'Say no to Underage drinkers' and the group's general Code of Practice and implement this.
14. Signs to be placed in prominent places about the laws relating to children & alcohol and to make sure customers are aware of the laws relating to selling & purchasing alcohol for or on behalf of children.
15. A "Challenge 21" policy will be operated. Only photo ID (e.g. driving licence and passport) will be accepted.
16. To always obtain a Criminal Records Bureau check & clearance prior to staff being placed in a position of supervising children for education or events workshop.
17. No child under the age of 14 will be permitted on the premises unsupervised by an adult at any time.
18. No person under the age of 18 will be permitted onto the premises unsupervised by an adult after 20.00 hours.
19. A refusal book shall be maintained showing details of when a refusal to sell alcohol takes place. The book will be made available to the Police/Licensing Authority for inspection upon request.
