LICENSING ACT 2003
CONDITIONS ATTACHED TO THE GRANT OF THIS LICENCE
This licence is granted subject to any Mandatory Conditions imposed by the Licensing Act 2003, Conditions volunteered on the application form to be undertaken by the applicant and where necessary, Conditions imposed by the Licensing Authority in order to promote the Licensing Objectives.
1. Mandatory Conditions:
a No supply of alcohol may be made under the Premises Licence at a time when there is no Designated Premises Supervisor (DPS) in respect of the Premises Licence OR at a time when the Designated Premises Supervisor does not hold a Personal Licence or his/her Personal Licence has been suspended.
b Every supply of alcohol under the Premises Licence must be made or authorized by a person who holds a Personal Licence.
c Any Door Security staff employed to carry out a security activity at the premises must be licensed with the Security Industry Authority (SIA).
d. In respect of the exhibition of films as mentioned below:
1 The admission of children to the exhibitions of any film is restricted as follows:
2 Where the film classification body is specified in the licence, unless 3(b) below applies, the admission of children is restricted in accordance with any recommendation of that body.
3 Where:-
(a) the film classification body is not specified in this licence, or
(b) the licensing authority has notified the holder of the licence that this subsection applies to the film in question,
the admission of children is restricted in accordance with any recommendation made by the licensing authority.
4 In relation to the above:
“children” means persons under the age of 18 years; and
“film classification body” means the persons or person designated as the authority under section 4 of the Video Recordings Act 1984.
Conditions consistent with the Operating Schedule
1 Any entertainment or events proposed will not involve any activities detrimental to children and will be aimed towards providing a general level of street entertainment for public enjoyment as an ancillary offer to their shopping or leisure visit to Radcliffe town centre.
2 There shall be a risk assessment conducted in respect of each licensed event.
3 Greater Manchester Police and Greater Manchester Fire Service shall be given advance notice of each event.
4 All events shall be conducted in an area covered by the town centre CCTV system. If a prior risk assessment indicated a likelihood of a substantial crowd gathering for a specific event or around an individual entertainer , which could provide an opportunity for personal theft, active controls would be implemented as part of the risk assessment process to move persons on or provide effective barrier control.
5 Account will be taken in regard to the advice given in the Bury Council Events Guidance Document.
6 Event organisers will arrange that appropriate staff are present to ensure event safety and promote the licensing objectives.
7 An assessment of potential litter nuisance will be made in respect of each event and where required, arrangements for the responsible disposal of and collection of litter shall be made.
8 There shall be an assessment of potential noise and other nuisance prior to each event.
9 No activity shall be conducted which is unsuitable for children, unless taking place in an over 18 venue.
