and\par \ldblquote film classification body\rdblquote means the persons or person designated as the authority under section 4 of the Video Recordings Act 1984. \par \pard\ltrpar\lang2057\f1\fs16\par \pard\ltrpar\fi-720\li720\lang1033\b\f0\fs20 2.\tab\ul Additional Mandatory Conditions pursuant to The Licensing Act 2003 (Mandatory Licensing Conditions) Order 2010,\par \pard\ltrpar\ulnone\b0\par \pard\ltrpar\fi-720\li720\qj\b\tab\b0 (1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.\par \pard\ltrpar\qj\par \pard\ltrpar\li720\qj (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-\par \pard\ltrpar\qj\par \pard\ltrpar\li1440\qj (a) Games or other activities which require or encourage, or are designed to require or encourage, individuals to-\par \par \pard\ltrpar\li2160\qj (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or\par \par supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or\par \par (ii) drink as much alcohol as possible (whether within a time limit or otherwise);\par \pard\ltrpar\li2160\par \pard\ltrpar\li1440\qj (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);\par \par (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;\par \pard\ltrpar\qj\par \pard\ltrpar\fi60\li1440\qj (d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-\par \par \pard\ltrpar\fi720\li1440\qj (i) the outcome of a race, competition or other event or process, or\par (ii) the likelihood of anything occurring or not occurring;\par \par \pard\ltrpar\li1440\qj (e) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.\par \pard\ltrpar\qj\par \pard\ltrpar\fi-720\li720\qj\b 3. \tab\b0 The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).\par \par \b 4. \tab\b0 The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.\par \pard\ltrpar\qj\b\par \pard\ltrpar\fi-720\li720\qj\par \pard\ltrpar\qj 5.\tab\b0 The following two conditions take effect as from 1\super st\nosupersub October 2010.\par \pard\ltrpar\fi-720\li720\qj\b\par \tab\b0 (1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.\par \pard\ltrpar\qj\par \pard\ltrpar\li720\qj (2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.\par \pard\ltrpar\li360\qj\par \pard\ltrpar\b 6. \tab\b0 The responsible person shall ensure that-\par \par \pard\ltrpar\li1440\qj (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-\par \pard\ltrpar\qj\par \pard\ltrpar\fi720\li1440 (i) beer or cider: \'bd pint;\par (ii) gin, rum, vodka or whisky: 25 ml or 35 ml; \par (iii) still wine in a glass: 125 ml; and\par (b) customers are made aware of the availability of these measures.\par \pard\ltrpar\par \b 7.\tab Definition:\par \b0\i\par \pard\ltrpar\fi720\b Responsible person - as defined by section 153 (4) Licensing Act 2003 - \par \pard\ltrpar\b0\par \pard\ltrpar\fi720\qj (a)\tab In relation to a licensed premises -\par \pard\ltrpar\qj\par \tab (i)\tab the holder of a premises licence in relation to a premises\par \tab (ii)\tab the designated premises supervisor (if any) under such a licence\par \pard\ltrpar\fi-720\li1440\qj (iii)\tab any individual aged 18 or over who is authorised for the purposes of this section by such a holder or supervisor.\par \pard\ltrpar\qj\par \pard\ltrpar\fi-720\li1440\qj (b)\tab In relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables him to prevent the supply in question.\par \pard\ltrpar\fi-1440\li1440\qj\tx1440\i0\par \ul\b Conditions consistent with the Operating Schedule \par \par \pard\ltrpar\fi-1305\li1440\qj\ulnone\b0 1.\tab Prior to the premises being traded under this Premises Licence an application for a transfer of the Premises Licence shall be made by the \par \tab proposed operating company.\par 2.\tab Prior to the premises commencing to trade under this Premises Licence any necessary approvals shall be obtained in respect of any\par \tab structural alterations or layout changes that may be required to the property.\par 3.\tab Prior to the premises being traded under this Premises Licence an application shall be made by the Premises Licence holder for \par \tab variation of this licence to specify a Designated Premises Supervisor with an effective Personal Licence.\par 4.\tab Prior to the premises being traded under this Premises Licence the Police and Fire Authorities shall be afforded the opportunity to inspect\par \tab the premises. \par \pard\ltrpar\fi-1440\li1440\qj\tx1440 5.\tab The Premise Licence holders shall have appropriate policies in place to ensure that alcohol is not sold unlawfully to minors.\par \pard\ltrpar\fi-1305\li1440\qj\tx1440 6.\tab The Premise Licence holder shall comply with any relevant Health & Safety legislation in respect of the operation of the premises.\par 7.\tab The Premises Licence holder shall comply with any reasonable requests of the Fire Authority.\par 8.\tab The premises will be constructed in accordance with current building regulation standards.\par \pard\ltrpar\fi-1305\li1440\qj 9.\tab The Provision of any amplified music from the premises shall not be audible at the nearest noise sensitive premises after 23.00 hours. \par 10.\tab Amplified live and recorded music shall not be provided in any external area of the premises after 21.00 hours. \par 11.\tab The Premises Licence holder shall ensure that the business participates in any pub watch or similar scheme which may from time to time be in place in the local vicinity of the property. \par \par \ul\b Additional Conditions reached through mediation with the Police \par \ulnone\b0\par 1.\tab That any external area when in use for the provision of licensable activities shall be clearly delineated with an appropriate boundary such\par \tab as coloured flooring, fencing, planting or other suitable barrier.\par 2.\tab The terminal permitted hour for the provision of licensable activities under this licence on New Years Eve shall be 4am (New Years Day \par \tab morning). \par \pard\ltrpar\fi-1305\li1440\qj\tx1440\par \pard\ltrpar\lang2057\f1\fs16\par } "
