LICENSING ACT 2003
CONDITIONS ATTACHED TO THE GRANT OF THIS LICENCE
This licence is granted subject to any Mandatory Conditions imposed by the Licensing Act 2003, Embedded Conditions carried across on conversion of your previously held Justices Licence, Conditions Converted from any previously held Public Entertainments Licence, Conditions volunteered on the application form to be undertaken by the applicant and where necessary, Conditions imposed by the Licensing Authority in order to promote the Licensing Objectives.
1. Mandatory Conditions:
a No supply of alcohol may be made under the Premises Licence at a time when there is no Designated Premises Supervisor (DPS) in respect of the Premises Licence OR at a time when the Designated Premises Supervisor does not hold a Personal Licence or his/her Personal Licence has been suspended.
b Every supply of alcohol under the Premises Licence must be made or authorized by a person who holds a Personal Licence.
c Any Door Security staff employed to carry out a security activity at the premises must be licensed with the Security Industry Authority (SIA).
d. In respect of the exhibition of films as mentioned below:
1 The admission of children to the exhibitions of any film is restricted as follows:
2 Where the film classification body is specified in the licence, unless 3(b) below applies, the admission of children is restricted in accordance with any recommendation of that body.
3 Where:-
(a) the film classification body is not specified in this licence, or
(b) the licensing authority has notified the holder of the licence that this subsection applies to the film in question,
the admission of children is restricted in accordance with any recommendation made by the licensing authority.
4 In relation to the above:
“children” means persons under the age of 18 years; and
“film classification body” means the persons or person designated as the authority under section 4 of the Video Recordings Act 1984.
Conditions consistent with the Operating Schedule
1. Prior to the premises being traded under this Premises Licence an application for a transfer of the Premises Licence shall be made by the
proposed operating company.
2. Prior to the premises commencing to trade under this Premises Licence any necessary approvals shall be obtained in respect of any
structural alterations or layout changes that may be required to the property.
3. Prior to the premises being traded under this Premises Licence an application shall be made by the Premises Licence holder for
variation of this licence to specify a Designated Premises Supervisor with an effective Personal Licence.
4. Prior to the premises being traded under this Premises Licence the Police and Fire Authorities shall be afforded the opportunity to inspect
the premises.
5. The Premise Licence holders shall have appropriate policies in place to ensure that alcohol is not sold unlawfully to minors.
6. The Premise Licence holder shall comply with any relevant Health & Safety legislation in respect of the operation of the premises.
7. The Premises Licence holder shall comply with any reasonable requests of the Fire Authority.
8. The premises will be constructed in accordance with current building regulation standards.
9. The Provision of any amplified music from the premises shall not be audible at the nearest noise sensitive premises after 23.00 hours.
10. Amplified live and recorded music shall not be provided in any external area of the premises after 21.00 hours.
11. The Premises Licence holder shall ensure that the business participates in any pub watch or similar scheme which may from time to time be in place in the local vicinity of the property.
Additional Conditions reached through mediation with the Police
1. That any external area when in use for the provision of licensable activities shall be clearly delineated with an appropriate boundary such
as coloured flooring, fencing, planting or other suitable barrier.
2. The terminal permitted hour for the provision of licensable activities under this licence on New Years Eve shall be 4am (New Years Day
morning).
